1. Introduction

  • Welcome to Informatech Solutions. These Terms & Conditions (“Terms”) govern your access to and use of our IT services, software solutions, consulting, digital products, websites, and any related platforms (collectively, the “Services”).
  • By using our Services, you agree to these Terms. If you do not agree, you may not use our Services.Informatech Solution is a Canadian-based firm, and all services are provided in accordance with applicable Canadian federal and provincial laws.

2. Services Offered

  • We provide a range of IT services, including App development, web development,  UI/UX services , IT support, digital markiting, and custom solutions tailored to client requirements.
  • Service details, timelines, and deliverables will be outlined in individual project agreements, proposals, or invoices.

3. Eligibility

You may use our Services only if you:

     

      • Are at least 18 years old,

      • Have the legal capacity to enter into a binding agreement, and

      • Agree to comply with Canadian laws and these Terms.

    4. Client Responsibilities

    Clients agree to:

       

        • Provide accurate project requirements, documents, and information.

        • Ensure timely communication and approvals during the project lifecycle.

        • Avoid sharing unlawful, harmful, or copyrighted data without permission.

        • Maintain the confidentiality of any login credentials or access provided.

      Any delay in delivering required information may result in project delays or additional charges.

       

      5. Payment Terms

         

          • All prices are quoted in CAD unless stated otherwise.

          • Payments must be completed as per the invoice or project agreement.

          • Deposits or upfront payments may be required before work begins.

          • Late or failed payments may result in suspension of delivered Services.

          • No refunds will be issued once digital work, development, or consultation has started, unless otherwise agreed in writing.

        6. Intellectual Property

        Unless stated otherwise in a separate contract:

           

            • All custom-developed software, designs, and code remain the intellectual property of Informatech Solutions until full payment is received.

            • After full payment, the final deliverables become the client’s property, except for licensed tools, third-party assets, frameworks, or proprietary methods used by Informatech Solution.

            • We retain the right to showcase completed projects in our portfolio unless the client explicitly requests confidentiality in writing.

          7. Confidentiality

          • Both parties agree to maintain the confidentiality of any business data, documents, source code, financial information, or personal information shared during the project.
            Confidentiality obligations continue even after project completion.

          8. Data Protection & Privacy

          • Informatech Solution follows applicable Canadian privacy laws including the Personal Information Protection and Electronic Documents Act (PIPEDA).
          • We only collect and use personal information to provide and improve our Services.
          • Clients are responsible for complying with privacy laws when collecting or sharing personal data through their own systems.

          9. Third-Party Tools & Integrations

          Our Services may involve third-party software, APIs, cloud hosting, or external integrations.
          We are not responsible for:

             

              • Downtime, security issues, or failures caused by third-party tools,

              • Licensing fees or restrictions imposed by third parties.

            Clients agree to follow the respective third-party terms and licensing requirements.

            10. Limitation of Liability

            To the maximum extent permitted by Canadian law, Informatech Solutions is not liable for:

               

                • Any indirect, incidental, or consequential damages,

                • Loss of profits, revenue, or data,

                • Delays caused by external providers, client inaction, or unforeseen events.

              Our total liability for any claim shall not exceed the amount paid by the client for the specific Service.

              11. Warranties & Support

              • We strive to deliver accurate and high-quality digital solutions.
              • However, all Services are providedas-is without warranties, except those explicitly stated in writing.
              • Post-launch support and maintenance are available only when included in the service agreement or purchased separately.

              12. Termination

              Either party may terminate a service agreement if:

                 

                  • The other party breaches a material term,

                  • Fees remain unpaid for more than the allowed timeframe,

                  • Mutually agreed in writing.

                Upon termination, clients must pay for all completed work up to the termination date.

                13. Governing Law

                • These Terms are governed by and interpreted in accordance with the laws of Canada and the Province of SK.
                  Any disputes shall be resolved in courts located in that province.

                14. Changes to Terms

                • Informatech Solution may update these Terms at any time. Updates will be posted on our website or communicated to clients. Continued use of our Services following changes indicates acceptance.
